OVERVIEW

This Text Messaging Policy explains how text messages (SMS/MMS) work when you interact with businesses using BDC Automation's communication platform. This policy applies to:

  1. Text Chat Widget - When you send a text message to a business through a text chat widget on their website

  2. Business Text Communications - When a business sends you text messages using our platform

Please read this policy carefully. By sending a text message through a text chat widget or by providing your phone number and consent to a business, you agree to this Text Messaging Policy.

WHO IS BDC AUTOMATION?

BDC Automation LLC provides technology services to automotive dealerships and other businesses. We provide the platform and tools that enable businesses to communicate with you via text message.

Important:

  • The Business (dealership, etc.) is sending you messages and controlling the communications

  • BDC Automation is the technology platform provider

  • Your consent to receive texts is with the business, not with BDC Automation

  • Questions about messages should be directed to the business that sent them

What Is the Text Chat Widget?

Some business websites have a text chat feature that allows you to send a text message directly to the business. This widget is powered by BDC Automation technology but operated by the business.

When You Send a Message Through the Text Chat Widget:

You Agree to:

  • Receive text message replies from the business

  • Receive follow-up communications from the business related to your inquiry

  • Standard SMS/data rates may apply (check with your mobile carrier)

Types of Messages You May Receive:

  • Responses to your initial inquiry

  • Information about products, services, or appointments

  • Follow-up communications related to your request

  • Business hours and contact information

  • Appointment confirmations or reminders

  • Sales and marketing information (if you've consented)

Message Frequency:

Message frequency varies based on your interaction with the business and your preferences. You may receive:

  • Immediate responses to your text chat messages

  • Follow-up messages related to your inquiry

  • Ongoing communications if you've opted in for updates

Your Rights:

OPT OUT ANYTIME: Text STOP to any message to unsubscribe from future texts from that business

GET HELP: Text HELP for assistance or contact information

NO PURCHASE REQUIRED: You are never required to consent to receive marketing texts as a condition of purchase

STANDARD RATES: Your mobile carrier's standard messaging and data rates may apply

How to Stop Messages:

To stop receiving text messages from a business:

  1. Text STOP - Reply "STOP" to any message from the business

  2. Contact the Business - Call or email the business directly to opt out

  3. Unsubscribe - Follow any unsubscribe instructions in messages

After you text STOP:

  • You will receive one final confirmation message

  • You will not receive further marketing or promotional texts from that business

  • You may still receive transactional messages (appointment confirmations, service-related)

  • To resume, you would need to opt back in by texting START or re-consenting

FOR CONSUMERS: BUSINESS-INITIATED TEXT MESSAGES

When a Business Texts You Using Our Platform:

Businesses using BDC Automation may send you text messages if:

  • You provided your phone number and consent to the business
    You have an existing relationship with the business
    You inquired about their products or services
    You opted in to receive text communications

The Business Is Responsible For:

  • Obtaining your proper consent before texting you

  • Honoring your opt-out requests

  • Complying with Do Not Call requirements

  • Following applicable laws (TCPA, state laws)

  • The content of messages sent to you

BDC Automation Provides:

  • The technology platform

  • Message delivery infrastructure

  • Opt-out processing tools

Important: If you have questions about messages from a business, or if you want to opt out, contact the business directly. BDC Automation is the technology provider; we do not control what businesses send or to whom.

YOUR CONSENT & PRIVACY

What Consent Means:

By providing your phone number to a business and agreeing to receive texts:

  • You consent to receive autodialed and/or prerecorded text messages

  • You understand that consent is not required to make a purchase

  • You can revoke consent at any time by texting STOP

How Your Information Is Used:

By the Business:

  • The business collects and uses your phone number and information according to their own privacy policy

  • Contact the business for questions about how they use your information

By BDC Automation:

  • We process your information as a service provider on behalf of the business

  • We do not use your phone number for our own marketing

  • We do not sell your personal information

Your Privacy Rights:

Depending on where you live, you may have rights to:

  • Access your personal information

  • Delete your personal information

  • Correct inaccurate information

COMPLIANCE WITH LAWS

TCPA Compliance:

The federal Telephone Consumer Protection Act (TCPA) regulates automated text messages and calls.

Business Responsibility: Businesses using our platform are required to:

  • Obtain proper consent before sending marketing texts

  • Honor opt-out requests promptly

  • Comply with Do Not Call requirements

  • Follow content and timing restrictions

Your Protection:

  • You can opt out of messages anytime (text STOP)

  • You never have to consent to marketing as a condition of purchase

  • You have legal rights under TCPA if businesses violate the law

BDC Automation's Role: We provide technology tools. We do not send messages, determine recipients, or verify consent. The business is responsible for TCPA compliance.

State Laws:

Various states have additional consumer protection laws regarding text messages. Businesses are responsible for complying with all applicable state laws.

PROHIBITED CONTENT

What You Cannot Send Through Text Chat:

When using text chat widgets, you may not send:

  • Violent, graphic, or pornographic content

  • Racist, discriminatory, or hateful content

  • Harassment or threats

  • Spam or unsolicited commercial messages

  • Content that violates intellectual property rights

  • Malware, viruses, or harmful code

  • False or misleading information

Consequences: If you violate these content rules, we or the business may:

  • Delete the content

  • Terminate your access to text chat

  • Report violations to law enforcement if appropriate

What Businesses Cannot Send:

Businesses using our platform may not send:

  • Deceptive or misleading messages

  • Prohibited content (see above)

  • Messages to numbers on Do Not Call lists (without proper consent)

  • Messages without proper identification

  • Messages in violation of TCPA or other laws

MESSAGE DELIVERY & LIMITATIONS

No Guarantee of Delivery:

Text message delivery depends on:

  • Your mobile carrier

  • Network availability

  • Your device settings

  • Carrier filtering and spam protection

We do not guarantee:

  • That all messages will be delivered

  • Delivery speed or timing

  • That messages won't be filtered by carriers

Your Carrier:
  • Standard message and data rates from your mobile carrier apply

  • Contact your carrier for information about your plan and rates

  • You are responsible for any charges from your carrier

Supported Carriers:

Our platform works with major U.S. carriers including AT&T, Verizon, T-Mobile, Sprint, and others. Contact support@bdcautomation.com if you experience delivery issues.

These commands work for messages from businesses using our platform:

STOP - Unsubscribe from text messages from that business
START - Re-subscribe (after you've stopped)
HELP - Get help information and business contact details
INFO - Get information about the text program

Contact the business directly. The business's contact information should be included in their text messages or available by texting HELP.

FOR BUSINESSES USING BDC AUTOMATION

If you're a business using our text messaging platform:

This Text Policy is for your customers. You must also comply with:

  • BDC Automation Terms of Service (https://bdcautomation.com/tos)

  • TCPA requirements for obtaining consent

  • Do Not Call compliance

  • State telemarketing laws

  • Carrier policies and 10DLC requirements

Your Responsibilities:

  • Obtain proper consent before sending marketing texts

  • Provide clear opt-out mechanisms

  • Honor opt-out requests within 30 days (or sooner as required)

  • Maintain consent documentation

  • Comply with all applicable laws

BDC Automation's Role: We provide technology tools. You are solely responsible for your communications compliance.
